Erie Pa Jan 12 - Attorneys for the estate of Theodore Nagle, millionaire boiler manufacturer, prepared today for an early appeal to the Pennsylvania supreme court from a verdict awarding Theodora Nagle $150,000 for defamation of character The jury's verdict upheld the contention of the 36 year old Erie that her character.

The jury's verdict upheld the contention of the 36 year old Erie woman that her character was defamed when Nagle wrote in his will that she was not his daughter. Miss Nagle was born a few months before her mother was divorced by Nagle, who charged his wife with adultery.

"I don't care so much about the money," Miss Nagle said last night when the jury reported after eight hours of deliberations, "but it makes me so happy to have the taint removed from my dead mother's name by this verdict."

The verdict of the jury, which included five women, was identical with the sum set aside by Judge Thomas P Trimble of Allegheny county orphans court early in Miss Nagle's litigation. He ordered the money held in court custody until Miss Nagle's action was settled.

It was Judge Trimble who called will "memorial wrath." He referred to the following passage written by the octogenarian millionaire although, Judge Trimble said, Theodora was regarded as his daughter. "I have two children only, a daughter, Edith A Nagle, and a son, Bailey B Nagle. Should any other person claim such a relationshiP to me and claim right to participate in the distribution of my estate, the claim would be a fraud."

Miss Nagle did not sue for a share of the estate. She asked damages for defamation of character. A $60,000 cash settlement was made on her mother when Nagle divorced her.
