Enlisted in the 7th U.S. Cavalry on 8 September 1873.

Was in Company D, under Thomas Weir. He was in the fight when Reno with some of the companies crossed the river to the end of the indian village in the Battle of the Little Big Horn. Fay was one of the lucky ones as he made it back across the river and onto Reno Hill.

Beings he was in Weir's troop there is a possiblity that he was among the troops that with Weir attempted to go to Custer's aid, but were driven back by hostile indians.

Fay was a plasterer by trade.
