Joseph Showalter made his will on Feb. 3, 1862. He specified that his farm of 80 acres in Chester Township, Wayne County, Ohio, together with all his personal property, be left jointly to his son Samuel and daughter Leah for the term of their natural lives, in exchange for care of Joseph and his wife, "Matty," for as long as they should live. After the death of Samuel and Leah the farm was to be sold and the proceeds divided among all the heirs.
Joseph died later that month. Matty lived until 1866. Samuel survived until 1906 and Leah until 1910. Finally, by May 1910 the estate was ready to be administered. The appointed executor, son-in-law Christian Mellinger, had also died, so Mellinger's son William took over. The property was sold by deed dated Jan. 3, 1911.
Some of the heirs had previously quitclaimed their interests to Samuel and Leah, specifically Jacob and wife, Lydia and Jacob Longanecker, and Mary and Peter Speck, all in 1870, and Isaac and wife, in 1869.
Consequently, the formula for distribution of the estate proceeds was exceedingly complex and decided by the court.
