Daniel Kutz was born in Cumberland County (according to his military records, but discrepancies in birth location are common). He is in the 1860 census living in Mechanicsburg but also was reported living with and/or working for farmer George Eppley in South Middleton Township, Cumberland County. He stood 5' 6" tall and had brown hair and hazel eyes.

A Civil War veteran, he enlisted in Harrisburg May 8, 1861, and mustered into federal service at Camp Harvey, Washington DC, May 28 as a private with Co. H, 7th Pennsylvania Reserves (36th Pennsylvania Infantry). He was captured at the battle of White Oak Swamp June 30, 1862, during the Seven Days' Campaign, incarcerated in Richmond, and paroled at Aikens' Landing on the James River August 5, 1862. He was captured again at the battle of the Wilderness May 5, 1864, and incarcerated at Andersonville until paroled at Charleston, South Carolina December 11, 1864. On his return home, he had to be carried "on a bed" from the train depot to his house.

He headed west after the war and married Mary A. McFeely February 9, 1870, in Sandoval, fathering George (b. 08/24/71) and Clara B. (b. 02/10/74). Mary died in 1876 and, with Daniel's death, Christofel Nicolay became the children's guardian.
