Due to his wife's opposition to secession, he was arrested, tried and sentenced to be hanged in 1863 in Murphy, North Carolina. His life was spared through the efforts of a state leader and others. After his move to Fannin County, Georgia, he was considered a patriot, and helped draft the 1877 constitution of Georgia.
