Herbert John Humphrey was born in 1863 in Manhattan, Kansas to Judge & Mrs. James Humphrey. His father, James Humphrey, came to Manhattan, Kansas from Nottinghamshire, England, in 1857. James was appointed district judge in 1867, and in 1870 came to Junction City and was a prominent attorney in the community. His mother, Mary A. Vance Humphrey, was originally from Springfield, Ohio and was an authoress and a very well known, active civic member of the state.

Herbert had two brothers and two sisters: James Vance Humphrey Jr. (1864-1956), Spencer Marshall Humphrey (1867-1895), Eleanor Humphrey Smith (1870-1932), and Miss Adele Humphrey (1874-1961).

Herbert graduated the University of Kansas Law School at the age of 18, became a lawyer, and was later appointed as Geary County attorney. Herbert married Miss Eleanor Houk in 1889 and died from complications of Typhoid Fever in 1890 in Hutchinson, Kansas. They did not have any children.
