Holdenville, May 4. - At their preliminary hearing today before Justice W. B. Poney of this city, Bert Sharp and Herbert H. Dark of Wetumka were placed under bonds of $1000 each for their appearance in district court sometime after July 1. They had no difficulty in making their bonds.

The state presented only enough evidence to make a case. Virtually all it attempted to prove was that the first shot fired in the fatal affair at Wetumka Saturday night, April 15, came from the car in which Sharp and Dark were riding. George Wilkerson, the third occupant of Dark’s car, was killed.

Greene Lewis, a deputy sheriff, was the only officer placed on the witness stand by the state. Two or three private citizens of Wetumka testified as eye witnesses to the shooting, but their testimony was vague and inconclusive. Lewis was with Hughie Rogers, town marshal of Wetumka, when the shooting occurred. Sharp and Dark both declared immediately after the affair that Rogers deliberately put his gun to the back of Wilkerson’s head and fired the shot that killed him.

What the defense’s evidence will be was not disclosed at the hearing today, as no witnesses in their behalf were placed on the stand. Sharp and Dark both were in the courtroom. Holdenville’s best legal talent is employed on both sides.
