Benjamin F. Sutherland passed away February 13, 2011, in Winston-Salem, N.C., following a long illness.

He was born February 19, 1918, a son of the late Simpson Holliday Sutherland and Pearl Rush Sutherland.

He was also preceded in death by his wife of 64 years, Sarah Cothron Sutherland; brothers, Jasper (Jack) Sutherland and John M. Sutherland; and sisters, Catherine S. Gilbert and Josephine S. Carico.

Mr. Sutherland is remembered in Clintwood for his many years of service to the community, his support of the local sports programs, and always wearing his hat outdoors and tipping it to people he passed on the street.

Mr. Sutherland was a life-long member of Clintwood United Methodist Church. He practiced law for over 60 years before he retired for health reasons in 2009. He was a member of the Virginia State Bar and Dickenson County Bar Association. Mr. Sutherland was a 1949 graduate of the University of Virginia School of Law and was a member of Delta Theta Phi law fraternity. He practiced law in Clintwood with his father, S. H. Sutherland before moving to Roanoke in 1954 as Assistant District Attorney, and then returning to Clintwood in 1956 to work for Clinchfield (Pittston) Coal Company. Mr. Sutherland then opened his private law practice in Clintwood in the early 1970s and practiced there until his 2009 retirement. His tenure in the legal practice in Clintwood included a term as Commonwealth's Attorney.

He was a 1934 graduate of Dickenson Memorial High School, and graduated from Berea College in 1938 with a bachelor's degree in Political Science.

Mr. Sutherland then went on to receive a master's degree from the University of Kentucky in 1940. He was drafted into the United States Army in 1941, attained the rank of captain, and served during World War II with the 44th Engineer Combat Battalion during the 1944 campaign in Normandy, France; in the Battle of the Bulge; and in the bridging of the Rhine River at Boppard, Germany in 1945 during the Allied advance into Germany, before his discharge later that year.

Mr. Sutherland is survived by a daughter, Sally S. Foulkrod and her husband, Bruce, of Jamison, Pa.; his son, Doug Sutherland and wife, Sally, of Mooresville, N.C.; and daughter, Carolyn S. Winters and husband, Steve, of Goodlettsville, Tenn.; grandsons, Matthew Foulkrod and wife, Betty, of Cranberry Twp., Pa., Steve Sutherland, a student at Furman University, Ben Sutherland, a student at the University of North Carolina, Greg Winters and Jared Winters, of Chandler, Ariz., and granddaughter, Leslie Winters, also of Chandler; great-grandchildren, Nicholas Foulkrod and Calleigh Foulkrod, of Cranberry Twp., Pa. He is also survived by his sister, Louise Sutherland, of Clintwood; his brother, Fred Sutherland (Ardath), of Sandston, Va.; his brother, William Sutherland (Virginia), of Abingdon, Va.; his sister, Jane S. Lyon, of Richmond, Va.; and his aunt, Rose Rush, of Clintwood.

He is also survived by many nieces and nephews, and great-nieces and great-nephews, and great-great-nieces and nephews.

His passions were his family; his law practice; reading; following sports, especially Kentucky basketball and St. Louis Cardinals baseball; and his World War II experiences and spending time with his army buddies, who were never far from his mind.
The family would like to thank his medical professionals and caretakers who professionally and lovingly prolonged and maintained the quality of his life.
Clintwood Funeral Home is in charge of arrangements. Visitation will be Friday at Clintwood Funeral Home from 5 to 9 p.m. The funeral service will be 10 a.m. Saturday at Clintwood United Methodist Church, and burial will follow at Temple Hill Memorial Park, Castlewood.
