Joel Halbert was living in Caroline County, Virginia, on October 28, 1754, when he signed a joint bond with his brother William; he died about 1762, when the widow "Frances Halbert" was appointed administratrix of his estate in Caroline County. In 1764, according to a Caroline County record, she "qualified as guardian for the children". (The names of all the children are given in this record, though some were apparently of legal age by the year 1764.)

In colonial times in Virginia, a child was declared an "orphan" when the father died, but not when the mother died. A legal guardian was appointed by the Court for any child of age 14 or less; over 14, and until of legal age (21 for boys, 18 for girls) the child choose his own guardian.
