He married Nancy L. Burns in 1852 and they had five children. Richard enlisted on March 20, 1862 at Liberty County, Texas for three years. He was captured at Arkansas Post on January 11, 1863 and sent as a POW to Camp Butler, Illinois. He was exchanged back to his regiment on April 10, 1863. January, 1864 listed as on Furlough in Texas and returned in March, 1864. His brother in law, Chelsey E. Burns served with him but died in Petersburg, Virginia on May 9th, 1863 from disease upon his exchanged from Camp Butler, Illinois. Richard's widow Nancy never remarried.
