Kerner was the father of two-term Illinois governor, Otto Kerner, Jr. As Attorney General of Illinois when prohibition was repealed, his opinion that the state law regarding the sale of 3.2 percent beer did not apply to the sale of liquor and other beverages of more than 3.2 percent, opened the doors for Chicago breweries to sell ales, stouts, and porters with a higher alcohol content. President Franklin Roosevelt nominated him to the United States Court of Appeals for the Seventh Circuit in 1938. He was confirmed by the Senate on February 1, 1939. He was offered Democratic Party backing, in 1940, for the gubernatorial nomination for Illinois, but declined to accept, choosing instead to remain on the bench. He did so until his death.
