Dies While He Awaits Ruling

Interesting Question May be Involved if Compensation Referee Has Made Award

No decision in the claim of Henry Harrison of Hornell, for compensation under the workmen's compensation law had been made public by Referee Smith at noon today, although Mr. Harrison died at his home in Hornell at 6:40 o'clock this morning and any award made later than that time will be ineffective.

The case was unusual. Mr. Harrison was injured on Mar 18, 1921, while employed by Tracey & Jones. He fell while descending a ladder into a coal bin, when the rungs gave way under him. According to the physicians the accident was the direct cause of his serious illness, resulting in his death.

Taking of the testimony was rushed with all possible speed in order to have the case submitted before Mr. Harrison's death. It was completed yesterday before Referee Smith held his session here, and he promised a decision last evening.

He could not be located today however, and whether or not he has made the award is not known.

According to the compensation law, it is said any award made after the death of a claimant is illegal and it is not necessary for an insurance company to pay the claim.
