The son of Joseph & Sarah Lay Ruby and husband of Sarah Jane Fishel Ruby, whom he married in 1872. In 1860, he was a laborer living in York Borough and later was a police officer. He stood 5' 3" tall and had brown hair and brown eyes.

A Civil War veteran, he enlisted in York August 4, 1862, with Co. K, 130th Pa Inf, at the rank of private. Discharged on a surgeon's certificate December 31, 1862, with the notation "feeble condition - never was fit for a soldier." That did not stop him from enlisting in York January 26, 1864, with Co. B, 187th Pa Inf, and serving at the rank of private until honorably discharged at end-of-term August 3, 1865.
