Tragedy Was Accidental Is Conclusion Made By Sheriffs Office

Weber County Sheriff John R. Watson said today officials had decided the death of James Thomas Ashby, 54, of 3530 Washington, who died of a gunshot wound Sunday was accidental.

After an investigation, he and officers concluded there was no need of an inquest and none will be held unless requested by the family.

Employers' Statements
Mr. Ashby died at twelve - five p.m. Sunday at the offices of the Uintah Dairy Products Co., 3667 Washington of which he was president.

Investigation revealed he had been cleaning guns at the time of the accident. He had cleaned two and was working on the third when it was discharged.

When police arrived, they discovered the barrel of a .32 - calibre rifle clutched in one hand. The bullet had entered the head beneath the chin and medical reports indicated death was instantaneous.

Mr. Ashby was alone in his office at the time of the accident. Miss Bernadine Anderson, 30, an employee was in the next room when she heard the shot. Another employee Denzel Shipley, 17, said he had been talking to Mr. Ashby, a few minutes before. He had told the youth he had not cleaned his gun since the hunting season so he decided to do it Sunday afternoon and then have them registered, according to the sheriff.

Native of Ogden
James Thomas Ashby was born September 3, 1887 in Ogden, a son of Thomas and Emily Coleman Ashby. He attended school in Ogden and lived here during his early life.

He married Eileen Helzler in the LDS Temple on November 10, 1909 and in 1917, 1918 and 1919 he served as an LDS missionary in South Africa. During that period he also served with the allied armed forces in Africa.

In Ogden, he operated a retail dairy products business, a roadside benchstand and a grocery service. On March 14, 1936, he married Clarissa A. Little in Las Vegas, Nevada.

He is survived by his widow of Ogden, his former wife, Eileen Ashby of Ogden, three sons and a daughter, J. Hetzler, John, Hal and Ardith Ashby of Ogden; his mother, Mrs. Emily Ashby Peterson of Ogden; three half-brothers, Samuel Ashby of Salt Lake City, Jay J. Ashby of Omaha and William Ashby of Los Angeles; four half-sisters, Mrs. Dalton J. Smith. Mrs. Derk Tabor and Mrs. Ed Jenkins of Los Angeles and Mrs. Earl Peterson of Ogden.

Burial Rites
Funeral services will be held Tuesday at two p.m. in the Aultorest Mortuary Chapel. There will be no viewing of the body. The service will be held under direction of former Bishop James M. Barbertson of the LDS Fourteenth Ward. Entombment will be in the Aultorest Memorial Park, in the Sunshine Crypt.

The petition of Clarissa Ashby praying for the appointment of Commercial Security Bank, a banking corporation of the State of Utah, as administrator of the above estate, and that Letters of Administration Issue to it, in the above entitled matter, has been set for hearing before Hon. Lewis V. Trueman, Judge, on Monday, the 13th, day of April, 1942, at 10 o'clock A. M., at the County Court House, in the court room of said court, In Ogden City, Weber County, Utah.
