Henry is divorced, aged 40 yrs (sic: 45 yrs old) and listed as brother to the Head of Household, Warren James Levi. Warren's wife, children and grandson Clellund, are also listed.

" In the Name of the Benevolent Father of all I Newton Levi do make and publish this my last will and testament revoking all wills if any be me heretofore made.
Item 1st... I have but a small amount of personal property at this time and no real estate but what ever I may own of either or both at my death shall become the property of my wife Eva Levi as provided in the Statutes of Indiana.
Item 2nd... I am keeping in force a policy or benefit in the Order of Modern Woodsmen of America for the sum of one thousand dollars and at my death one half of said sum derived from said benefits to become the property of my wife Eva Levi and one half the property of my son Earnest Levi. The four fifths part of each I request to be invested in a home for said two legatees while said Earnest is under the age of twenty one years, but each to own one half interest therein. And should said Earnest depart this life before he arrives at the age of twenty one years then the one half interest in said fund or that portion invested in real estate for him, the said Earnest Levi, shall be owned and controlled by the said Eva Levi during her natural life and whatever portion of the interests of the said Earnest Levi have not been expended for his benefit and for the benefit of the said Eva Levi it is my request that such balance be divided equally between my brother Rabb Levi and my niece Mrs. Bess Brown.
Item 3rd... It is my desire and I hereby authorize the said order of "Modern Woodsmen of America" by its proper officers to pay said money into one of the National Banks of Rushville, Indiana, and have the same placed to the credit of said Eva Levi to be drawn out by her after she has qualified as guardian for the said Earnest Levi and as the four fifths parts of his money is required to be invested in real estate it is my desire that the court shall only require of her a nominal bond.
Item 4th... Should my wife the said Eva Levi die before my said son, Earnest Levi arrives at the age of twenty one years then the one half part of household goods that remain shall become his property and I request that my brother Rabb Levi or my niece Bess Brown qualify as his guardian and aid in maintaining him a home.
In witness whereof I have hereunto subscribed my name to this my last will and testament in the presence of two witnesses who names are hereunto attached this 28th day of May, 1907.

Hall one of the subscribing witnesses to the within and foregoing last will and testament of Newton Levi late of said County, deceased, personally appeared before William A. Posey, Clerk of the Circuit Court of Rush County, in the State of Indiana, and being duly sworn by the Clerk of said Court upon his oath declared and testified as follows; That is to say; That on the 28th day of May, 1907 he saw the said Newton Levi sign his name to said instrument in writing as and for is last will and testament and that this deponent at the same time heard said Newton Levi declare said instrument in writing to be his last will and testament and that the said instrument in writing was at the same time as the request of the said Newton Levi and with his consent attested and subscribed by said affiant and William W. Wolfe in the presence of said testator and in the presence of each other, as subscribing witnesses thereto and that the said Newton Levi was at the time of the signing and subscribing of said instrument in writing, as aforesaid, of full age (that is more than twenty one years of age) and of sound and disposing mind and memory and not under any coercion or restraint as said deponent verily believes and further deponent says not.

Hall, one of the subscribing witnesses thereto and that a complete record of said will and of the testimony of the said Frank J. Hall, in proof thereof, has been by me duly made and recorded in Book 6 at pages 54 and 55 of the will records of said County.
In attestation whereof I have hereunto subscribed my name and affixed the seal of said Court at Rushville this 5th day of September, 1907.
