Research of Tommye Faye Fleming Kelly was used for James Lester Fleming's Civil War Record. Tammy Faye Fleming Kelly found that Grandpa Doc enlisted June 9, 1861 in Berlin, Arkansas, at the age of thirty-four; joining for the duration of the war. He was a private in Captain Caper's Company of the 3rd Arkansasn Infantry, Army of the Confederacy of the United States of America. He was sent to join Lee's Army of Northern Virginia at Lynchburg, where he served for a time as a Wagon Master in the Quartermasters Corps. Grandpa Doc returned home to Arkansas for furlough February 10, 1862. At some point in 1862, probably during the time he was home on furlough, he apparently bought land in Drew County (which he sold later to his brother, Francis). He returned to Lynchburg on March 17, 1862, where he continued to serve until November 22, 1862, at which time he was hospitalized in Chimoborago Hospital Number 2, Richmond, Virginia. He was transferred to Palmyra on December 1, 1862. On January 31, 1863 he was granted a furlough to return to Arkansas. Further muster rolls show "Absent - Sick in Arkansas". The final date on his record reads April 10, 1863. His facsimile signature appears on two receipts for pay while at Camp Mason, Virginia. The war ended in April 1865 and in October they sold their land (400 acres) in Drew County to his brother Francis Fleming for $1,500 and moved their family to Burleson County, Texas sometime in 1866.

The location of the present headstone is not the location of the burial of James Doc Fleming. The oral family story is that the grave was dug in the wrong place, the funeral attendees arrived near dark and buried him in the space prepared, which is about thirty feet from his family. Older family members knew the space which was marked with a red rock at the foot of a cedar tree to the right of the fence dividing the two cemeteries. Note: this fence was removed about 2009 which divided the two cemeteries.
