Whereas I Jacob Gish senr. of Botetourt County and State of Virginia being old and willing to withdraw from the bustle of the busy world, and also considering the frailty of human life, and that all mankind are born to die, I think proper to make, constitute and ordain this my last will and testament in the manner and form following:
Item 1st: To my grand daughter Cassy Vinyard who is the only heiressof my daughter Elizabeth Vineyard, Formerly Elizabeth Gish, three tracts of land, he mentions his son in law Christian Vineyard. 2ndTo my son John Gish I give and bequeath the tract of land where on henow lives. 3rd To charles Carney my son in law and Susannah his wife formerly Gish. I give the tract of land where on they now live. 4th To my son Abraham Gish I give the old place where on I now live or a part of it etc. etc. 5th To my son in law david Sparry and Caty his wife, formerly Caty Gish, I give a tract of land near Amsterday. 6th To my son Jacob Gish I give a tract of land of one hundred and fifty two acres. 7 To my son in law George Lemon and my daughter Polly his wife I give a tractof land containing 255 acres. 8th To my son in law Peter Nininger and daughrter Lydia I give a part of the old tract of land. 9th It is mywill;that my daughter Ann who is now married to Samuel Moomaw, that she andher said husband have the next choice ot choose the middle tractthat lies between my son Abrahams and Peter Nininger;s tracts, 10th Tomy daughter copy Gish I give next choice of the two tracts of land that shall be lelt after S. Moomaw and his wife Ann have made their choice. 11th To my daughter Priscilla Gish I allot the remaining tract.
Jacob first married Ann Vinyard. After her death he married Catherine Stoiver. He came to Daleville, Va from Pennsylvania in 1792 with his family. He died 2 Aug 1836. Jacob purchased 500 acres of Breckinridgeland from his father by deed dated Oct. 13, 1795. This land was on Tinker Creek and the conveyance included the home place. In Jacob's will he lefrt part of this land to his son in law, Peter Nininger and his daugtherLydia. Nininger later acquired additional land from the Gish estate. This land eventually came into possession o Peter and Lydia Nininger's son, Benjamin F., and was the place where he started Daleville College. Abeautiful old stone house still stands in the village of Daleville which is known as the Benjamin Nininger hom, however, it is thought that this was built by a member of the Gish Family
