He is listed in the 1900 census as E Aker, age 13, and living with his parents and siblings in Lead Mine, Wythe, Virginia.
He is listed in the 1910 census as Ellis Akers, age 23, single, and living with his parents and siblings in Spring, Mercer, West Virginia. His occupation is a Coal Miner.
So he can't be the 14 year old boy accidentally hit by a train.
