Police continue to investigate a Sunday afternoon drive-by shooting that killed one man and critically injured another.

Acie Robinson, 27, who lived near 25th Street and Kansas Avenue, had been sitting on a porch in the Miller Park neighborhood with Dexter Levering, 24, and Damian Tiffin, 28, when someone in a passing vehicle fired.

Robinson, shot in the head, was pronounced dead at the Nebraska Medical Center, said Officer Jacob Bettin, a spokesman for the Omaha Police Department.

Levering was in critical but stable condition at the same hospital. Police said he lives at 2429 Newport Ave., where the shooting occurred about 12:30 p.m.


Tiffin, who lives near 58th and Fort Streets, was treated and released.

Police are investigating whether the shooting was motivated by gang activity, said Lt. Darci Tierney, a police spokeswoman.

Part of the investigation is whether a report of shots fired about 45 minutes earlier was related to the fatal shooting. Officer Jacob Bettin said officers responded to a shots fired call near 24th Street and Kansas Avenue. No one was injured in that shooting. No arrests have been made in either case.

Neighbors, who out of fear asked not to be identified, said the victims were sitting on the porch when a red or burgundy sedan drove up and gunfire broke out.

"It sounded like a string of fireworks," one neighbor said. "There were about eight shots, then a pause and then about eight more shots."

When the sedan sped away, neighbors came outdoors to survey the scene.

"One (shooting victim) was running around the front yard, and one was laying there on the porch shot in the head," a neighbor said. "I didn't see the third (victim)."

Several neighbors said the house has been a constant source of concern, with visitors coming and going at all hours.

Most of the houses on the block appear well-maintained. Several neighbors said they have lived in the area at least 20 years.

One longtime resident said she and her family have called the police numerous times regarding the house where the shooting occurred.

"We're getting really sick of the behavior there," she said. "The police come talk to them, and then they drive away. We want this to come to an end before someone else gets hurt."

The three men have all been in trouble before.

Robinson, received probation in 2006 after being convicted of possession with intent to deliver crack. His brother, DeAndre Robinson, was shot and injured in a 2003 drive-by shooting in which his four-month-old son, DeAndre Jr., was shot and killed in his mother's arms. Terron Brown pleaded no contest to second-degree murder in that case and is serving 30 to 40 years in prison.

DeAndre Robinson was a gang member, police said at the time.

Damian Tiffin served 90 days in jail in 2002 for possession of crack. He and Jimmy Levering were was shot in September 2008 while walking on a sidewalk. Neither man's injuries were life-threatening. It was not known whether Jimmy and Dexter Levering are related.

Tiffin was ordered to stand trial last year on a robbery charge that later was dismissed.

Dexter Levering served 90 days in jail for assault and weapon-use charges in 2006.
