Judge Josiah Scott was elected as a Whig to the Ohio House of Representatives in 1840 and in 1856 he was nominated by the Republican Party and became an Ohio Supreme Court Judge. In 1872 he returned to private practice and 1876-1879 he was appointed to the Ohio Supreme Court Commission.

He first married Elizabeth McCracken in 1838 and they had 5 children before she died in 1844. In 1846 he married Susan Elizabeth Moffett Austin, a widow, in Cincinnati. They lived in Ohio including Fairfield and Hamilton and by 1870 in Bucyrus where Susan's sister Sallie lived. In 1870 Judge Scott developed a method to construct magic squares which was published in 1871 by the Mathematical Society of London.

Judge Scott died in 1879 and Elizabeth in 1891, both in Bucyrus.
