CHILDREN SUE AGED MOTHER
Secure Accounting In a Small Estate After Thirty Long Years.
Thirty years is a long cry in a probate tangle, but yesterday such a kink was straightened out in the Superior court, and as a feature of additional interest the contest, which was at issue, involved two children pitted against an aged mother.
The suit was by George I. Day and Mrs. Georgiana Perdew, brother and sister, against their aged mother, Mrs. Martha Day-Shrode, the children now themselves long past the period of youth.
They sued for an accounting of a little estate left to them and a sister, now deceased, by their father in 1849. The aged mother had been appointed guardian of the estate, and lacking business capacity had little to show for the property when the search light of the law was turned upon the faded, time-worn report which she had made years ago.
The suit finally reached a compromise before the court, the aged woman promising to try and pay $700 and seven per cent on this sum for a certain period. Since the order was made 30 years ago appointing her guardian, death has laid low a number of attorneys who figured in the estate, together with the appointing judge, and persons long indebted to the estate.

In the 1910 U.S. census, 38 yr. old Georgia Anna Perdew, b. in CA., was living on Etiwanda Ave. in Cucamonga, San Bernardino, CA. with her
58 yr. old husband, Rufus P. Perdew, a farmer on the home farm, b. abt. 1852 in IA.
17 yr. old daughter, Birdie (Leone) Perdew, b. in CA.
12 yr. old son, Putman (Putnam) Perdew Jr., b. in CA.
9 yr. old daughter, Florence Perdew, b. in CA.
7 yr. old daughter, Mamie Perdew, b. in CA.
6 yr. old daughter, (Etta Mae) Etiwanda Perdew, b. in CA.
3 yr. old son, (George) Ralph Perdew, b. in CA.
1 1/2 yr. old son, Victor Perdew, b. in CA.
Rufus's parents were both b. in IA.
Georgia Anna's father was b. in England & her mother in TX.
This was a second marriage for Rufus Sr. and a first marriage for Georgia Anna. They had been married for 20 years. Georgia Annie was the mother of 9 children, only 8 still alive by this census.

BOWLAND SAYS CLAIMS STALE
Answer Filed in Action Brought by Former Wards of Mrs. Martha Shrode
George P. Bowland of this city, who was recently made a defendant in an action brought by George I. Day and Georgiana Day Perdew, today filed his answer. The plaintiffs assert that Bowland, some thirty thirds ago, became the bondsman of Martha Shrode, their mother, as their guardian. With Bowland as surety was A.G. Perdew.
Perdew borrowed $1200 from Mrs. Shrode, and it was never returned to the estates. In the meantime one of the wards married Perdew’s son, widower of a sister of Georgiana.
The answer is that the guardian, Mrs. Shrode, became mentally weak in 1894, that Georgiana Day Perdew became of age eighteen years ago, that George I. Day became of age thirteen years ago and his estate is distributed and cannot be called upon to pay the loss. Rowland’s position is that all these years those interested in the case have known of the conditions, and that they cannot now under the law collect from him on what his answer designates a “stale claim,” that they should have taken steps years ago.
Mrs. Perdew lives in San Bernardino county. Montgomery & Tarver represent Bowland.
