BORGER, May 25 (AP) - Frank Ackers [sic] was shot to death last night when Henry Neely, dairyman, caught him and another man in the act of milking cows in the Neeley dairy yard.

A murder charge was filled against Neeley in connection with the killing. Neeley claimed the numerous milk thefts had occurred recently at his dairy.

James Thompson told officers he and Akers [sic] went to the dairy yard to obtain milk. Akers [sic] was carrying a bucket as they went from cow to cow.

They had been in the yard about 30 minutes when Neeley appeared with a rifle in his hands, Thompson said. Neeley ordered them to raise their hands. Thompson heard a shot and saw Akers [sic] fall to the ground.

Thompson said he fell flat for fear he too would be shot.

Akers [sic] formerly was employed by an oil company. His wife told officers that fresh milk was not used in their home. She said only canned milk was used.
