According to the Southwestern Reporter on June 9, 1915, Elben's father Walter Forest opened a lawsuit against Western Union Telegraph Company for the "delay of delivery in a telegram advising [him] that his child was not expected to live through the night. The petition alleged that if the telegram had been delivered with ordinary promptness, the plantiff, by taking a certain route would have been at the bedside of the child" for his death.
