Son of Elizabeth Akers and Archibald Rutherford who were born in Virginia. Shelby R. Rutherford was born in Jessamine County, Kentucky. His father served in the American Revolution as a private soldier in Captain Joseph Crockett's Company, 7th Division Virginia Regiment.

In 1832, Shelby first married Belvina Inman (daughter of Henry Inman and Rebecca Judkins) in Logan County, Kentucky.

Five children were born from his marriage to Belvina: Henry Archibald, Rebecca Catherine, Harriet E, James William, and Shelby Taylor Rutherford. Belvina died in 1847 in Logan County, Kentucky.

By 1850, Shelby was enumerated with his children in Butler County, Missouri

In Butler County, Shelby Rutherford married Nancy Jane Woodell, April 4, 1852. It is unknown if they had children but they divorced shortly after marriage.

He then married Charity Thurman (daughter of John Thurman and Fanny Sonley of Sevier County, Tennessee) about 1859. They resided in Blount County, Tennessee. From his marriage to Charity, Ashley Rutherford was adopted by Shelby and one child, Robert S. was born.

By 1860, Shelby and family migrated to Sebastian County, Arkansas where he and Charity lived the remainder of their years.

Shelby's daughter, Rebecca Catherine and her husband, Samuel Thurman, moved from Butler County, Missouri a few years later but they eventually moved on to McAlester, Oklahoma, where her brother's brother-in-law, J.J. McAlester, engaged in a variety of businesses and eventually became lieutenant governor.

OBITUARY:

Mr. Rutherford was born May 9, 1805. Came to Arkansas from Logan county, KY. Died April 4, 1879...nearly 74 years of age. He was a quiet, jovial, inoffensive man, a farmer near Vache Grass, in this county...was sick some time and suffered much pain for some two weeks before his death, but died happily. He leaves four children, all of whom are about of age. We attended his funeral on the 6th, int. at Steep Hill.
