On Sunday August 2nd, 1987 traveling in a van driven by his older sister; Shelley Leanne, Luke Allen James & another sister; Melinda Sue James sustained injuries when Shelly lost control and the van left the road. Several people witnessed the accident, offered aid and called for assistance, but were rebutted by all family members stating their church (The Church of the Firstborn of North Plains, Oregon; a fundamentalist branch of LDS) beliefs of non medical interference. An uncle arrived at the scene of the accident and took all the occupants (James family children, as the parents were out of the town at the time) of the van home. Aid had already been called and deputies went to the home for a well child check. Luke was pronounced dead around midnight, and Melinda Sue James went to the hospital upon the deputies seeing she needed aid and summoning an ambulance. On Monday 08-03-1987 The State of Oregon went to court to provide Melinda aid, and the parents rebutted. A judge ruled only lifesaving aid would be administered. In the evening of Monday 08-03-1987, once Melinda was deemed stable, she returned home. Later articles indicated that Luke's injuries were severe enough that even with medical aid, he may not have recovered.
