An argument which started in a local tavern led to the fatal shooting of a Barstow man and serious injuries to a second local man early this morning, the Barstow Police Depart reported.

Floyd B Ulivarri, 23, 607 1/2 East Williams, was fatally injured by a bullet which passed through his chest the police stated.

Gary Lynn Gage, 20, 325 South First St was shot twice in the shoulder and chest and was reported in fair condition at St Bernardine's Hospital.

The Barstow police said the two men were shot by Eric Hahn, 29, 294 1/2 North First St in self defense after they entered his apartment to continue the argument.

Police Sgt Herb Shaw stated that a report of the fatal shooting would be turned over to the District Attorney's office but that the police considered the death a justifiable homicide. Hahn has not been arrested or charged with a crime.

The tragic argument reportedly stated in the 2C's tavern, 206 North First St at about 1:30 am today when Hahn came in to purchase a six-pack of beer for himself and a friend, 2nd Lt James McAfree, 20, Fort Irwin.

Hahn became engaged in an argument with Ulivarri and Gage, who were inside the tavern, according to the police report. Hahn then left and went inside his adjacent apartment. Ulivarri and Gage reportedly stood beneath the stairway to Hahn's resident for several minutes and then entered the apartment to continue the argument.

Hahn, who told police he feared for his life because Gage was a much larger person physically, reportedly picked up a gun and asked the two men to leave. He then set the gun down and Gage and Ulivarri pushed him and McAfee, according to the police.

Hahn then shot Gage twice in the right shoulder and left side of the chest, the police said, and also shot Ulivarri after the victim hit him on the head.

Gage collapsed in the apartment. Ulivarri, although the bullet had entered the right side of his cheset and exited from the left rear of his back, staggered outside the apartment, down the stairs and collapsed in the City Garage parking lot. When he was being loaded into the ambulance, he reportedly said to Gage, "We should have gone home, Gary." the police related. Both men reportedly were able to basically substantiate Hahn's account of the shooting.

Hahn was treated at Barstow Hospital for head lacerations suffered in the altercation and was reported extremely distraught over the matter. McAfee was kicked in the groin, police said.

The shooting was investigated by Sgt Show, Detective Robert Smith and Officers R Glen Blackmon and Richard Foster of the Barstow PD.)
