"Funeral rites for Mrs. Andy M. (Martha Nell) Rutherford, 32, whose death from gunshot wounds occurred Wednesday at Kingsport, Tenn., will be held here Monday afternoon at 2 p.m. at the Howe funeral home.

"Rev Irvin King, pastor of the Burney Baptist church will officiate. Burial will be in the Milford cemetery.

"The body is being returned here and friends may call at the funeral home after 3 p.m. Sunday.

"Mrs. Rutherford, the daughter of Mr. and Mrs. Elda R. Hancock of this city, was born near Burney on March 16, 1920. (She graduated from Burney High School in 1939/ja) She was united in marriage to Andy M. Rutherford on Dec. 10, 1944, at Columbia, S.C. She was affiliated with the Burney Baptist church.

"Besides the husband and parents, she is survived by two children, Mary Jane Rutherford, 6 and John Mitchell Rutherford, 2; one brother, Lewis O. Hancock, of Burney; four sisters, Mrs. Anna Mae Clark, of New Point; Mrs. Leva Ellen Miller, of Michigan City; Mrs. Lela Ruth Schock, of Muncie; Mrs. Ester Gail Dale, of Westport; and several nieces and nephews."

"Kingsport, Tenn., Dec. 11...A 79 year old great-grandmother was charged with the murder of her grandson's wife today at Kingsport and released on $10,000 bond.

"Mrs. Ollie Rutherford denied the charge and claimed her granddaughter-in-law, Mrs. Martha Hancock Rutherford, took her own life.

"Constable J. E. Upchurch, one of the investigating officers said: 'Suicide seems unlikely because there were so many shots. Mrs. Rutherford was shot twice in the chest and once in the back.' The victim's husband, Andrew Mitchell Rutherford, a preacher, was not at home at the time of the shooting Wednesday afternoon. The victim's baby was in a crib and unhurt during the shooting."

"She was born near Burney on March 16, 1920. After graduating from the Burney high school, she moved to Greensburg with her parents 10 years ago. She resided here about one year before her marriage to Andrew Mitchell Rutherford, of Virginia.

"First information about her death was received by Decatur County Sheriff Earl Marlow in a telephone call from the sheriff of Sullivan county, Tennessee. Sheriff Marlow said he was told that Mrs. Rutherford had been shot twice with a .32 caliber revolver, once in the shoulder and once in the chest.

"Mrs. Rutherford was the mother of two small children, Mary Jane, 6 and John Mitchell, 2. Besides the husband, children and parents, she is survived by four sisters, Mrs. Paul (Lela) Schock of Muncie, Mrs. Louis (Leva Ellen) Miller of Michigan City, Mrs. Lewis (Anna Mae) Clark, of New Point, and Mrs. Vanus (Esther) Dale of Westport; one brother Lewis Owen Hancock, of Burney, her maternal grandmother, Mrs. Kitty Hunter, of this city; and several nieces and nephews. Preceding her in death was a three year old son, Elda Thomas, who passed away in 1948.

"Funeral arrangements have not been announced pending the return of the brother and two brothers-in-law, who went to Kingsport, Tenn. today."
