He was a German count and lawyer and a member of the opposition against Adolf Hitler in Nazi Germany, also a founding member of the "Kreisauer Kreis" resistance group.

Attended the University of Breslau where he studied law and political sciences, and Oxford University where he completed English legal training.

Moltke was arrested by the Gestapo in January 1944 and imprisoned at Tegel. He was sentenced to death for treason on January 11, 1945 and executed twelve days later at Plötzensee Prison in Berlin.

Husband of Freya (Deichmann) Von Moltke (b. March 29, 1911 Cologne, Germany; d. January 1, 2010 Vermont, USA at 98 years); they were married in 1931 in Cologne, Germany. Father of Helmuth Caspar Von Moltke (b. 1937) and Konrad Von Moltke (b. September 23, 1941 Germany; d. May 19, 2005 Vermont, USA at 63 years).

Son of Dorothy (Rose Innes) who was of South African / British descent.
Grandson of Jessie (Dods Pringle) and Sir James Rose Innes (b. January 8, 1855 Grahamstown; d. January 16, 1942 Kenilworth, Cape Town at 87 years) who was Chief Justice of the Union of South Africa until 1927.
Son-in-law of Ada (Von Schnitzler) and Carl Theodore Deichmann.

2001 - the German Section of the International Society for Military Law and the Law of War established the Helmuth-James-von-Moltke-Preis for outstanding judicial works in the field of security policy.
1992 - A documentary film based on his letters, diaries, and other papers The Restless Conscience: Resistance to Hitler Within Germany 1933-1945 by Günter Brakelmann.
March 11, 2007 - Moltke's centenary was commemorated in the Französischer Dom in Berlin, where he was described by German chancellor Angela Merkel as a symbol of "European courage".
