He was the son of Mathew Mann Drake & Winefred Fitts. He attended Randolph Macon College. Civil War service record shows enlistment as Captain on August 16, 1861, age 29, Co. B, 30th Infantry Regiment, NC. He served until June 11, 1863 when he had to resign due to ill health. After a few months, his health improved and he was appointed command of the 6th Battalion of NC troops and promoted to Major. He was acting as Judge Advocate of a General Courts Martial, appointed by Gov. Vance, when Lee surrendered. After the war he continued farming and teaching school in Warren County. A commissioned Magistrate, he was elected Judge of the Inferior Criminal Court and in 1885 was elected Superintendent of Public Instruction for Warren County.
