John Durham emigrated to Ohio from Virginia in 1816, and settled on the waters of Deer creek. His family were Ralph, Jeremiah, Elizabeth, Dennis, Joel, Permelia, Mary, and Sebina. Mr. Durham was a soldier in the revolution, a fifer, was taken prisoner, put on a British ship of war, sent to sea, and was not exchanged until peace was declared; in 1812 he served as a fifer. By occupation a farmer; born April 13th, 1760, and died in 1852; his wife, Mary, was born 1771, and died in 1046 [sic].

Abstract of Partition Petition of John Durham's lands in Pickaway County, Ohio, February Term 1853

John Durham's daughter Elizabeth, wife of Joseph Britton of Fayette County, Ohio petitions the Court of Common Pleas of Pickaway County, Ohio for "their legal right to" one undivided ninth part of the value of the Real Estate of John Durham deceased. The petition is brought against her siblings as follows:
· Catharine Houghf, wife of Jacob Houghf of Virginia
· Heirs of Nancy Grant, formerly wife of Willis Grant of Indiana (names of heirs unknown to Elizabeth)
· Ralph Durham of Fayette County, Ohio
· Jeremiah Durham of Fayette County, Ohio
· Joseph Durham of Pickaway County, Ohio
· Dennis Durham of Indiana
· Heirs of Permelia Gamble, formerly wife of Jefferson Gamble of Illinois (names of heirs unknown to Elizabeth)
· Mary Peniwell, wife of James Peniwell of Illinois

The Court appoints 3 commissioners to appraise the value of the land (2 separate tracts)
· Noble Porter
· James F. Wilson
· Moses Adams

The commissioners value the land at $17/acre and determine that it cannot be divided into nine equal portions without devaluing the land.

The Petitioners, Elizabeth and Joseph Britton, elect to have the estate sold at public auction rather than to sell at the appraised value.

The Court orders that the land be sold at auction after November 22, 1852 and an advertisement is placed in the Circleville Herald on September 24, 1852 for 6 weeks.

The Court orders the Sheriff of Pickaway County, John Bryer, to conduct the auction of the lands after a new survey is conducted by Jacob W. Burget, County Surveyor. The auction takes place on the premises on Tuesday, February 15, 1853 at 1:00 pm. The total amount of land equals 115 acres and 20 poles. The terms of sale are 1/3 cash in hand, 1/3 in one year and 1/3 in two years with interest on the deferred payments from the day of sale to be secured by mortgage on the premises.

Joseph Durham buys the land for $24.38/acre and the proceeds minus expenses are divided into nine equal shares among the nine heirs of John Durham. The actual amount disbursed is blank for each.
