In his Last Will & Testament dated 15 July 1922, Timothy stated: I, Timothy O'Leary of Woodville in the District of Hawkes Bay, Give and Bequeath the whole of my estate both real and personal of whatsoever nature and wheresoever situate, unto my wife Honorah O'Leary absolutely should she survive me and should she predecease me then to the Roman Catholic Archbishop of Wellington to be used by him for the purpose of promoting and assisting Roman Catholic primary education at Woodville, provided however and I direct, that if at the time of my death there is no school erected at Woodville for the purpose of Roman Catholic primary education the proceeds of my estate are to be utilised for that purpose and I declare that the receipt of the Roman Catholic Archbishop of Wellington for the ti being shall be a sufficient discharge to my trustee for the purpose of the foregoing trust.
