Judge James E. Horton Sr., died on 28/29 Jan. and was buried in the Athens Cemetery, survived by the widow, one son, J. E., Jr., and daughters, Mrs. Edward Estes and Mrs. J. W. Frost of Athens.

Born in Madison Co, on 20 May 1833 to M/M Rodah Horton, descendants of distinguished Virginians, he came with his family to Limestone in 1857.

He attended the State University and the U. of Virginia. He was one of the most progressive planters in the county at the outbreak of war.

He served in the CSA and for a time was on the staff of Gen. Daniel S. Donelson, one of the most distinguished men in Tennessee, whose daughter, Emily, he married.

After the war, J. E. Horton was elected to the board of county commissioners and became probate judge in 1886, serving 18 years in that position. "He probably gave away more than he made, quietly, he was never a man of many words, but had well-balanced and sound Ideas," said the obituary. "His opinions, when he chose to express them, were always clothed with an anount of sensible argument that made them worthy of attention."
