reduced to his possession, including four slaves, for the purpose of division and distribution among the heirs and "Distributees of said decedent,and for the reason that said property is incapable of division and distribution without a sale thereof. It is ordered that citation of Scott County, to be served on William Myers, and to Rankin County to Be served on Calvin Myers, Henry Myers, Carmen Myers, Alvin Myers and Amanda Myers, daughter of Chapman Myers deceased, and William L. Ragland, Anselm Ragland, Orassamus Ragland, Mary Jane Ragland and Louella Ragland-and to Simpson County to be served on Pryor T. Berry, Elizabeth Berry his wife, late Myers, and also Abel Thurman and his wife, Martha Thurman, late Myers, and Aphalonia, Leonidas, Nancy, Alonzo, Pizano, Thomas and Catherine Myers, children heirs of Chapman Myers, dec'd. late in Simpson County- and Laura, C.E. and William E. Jackson her husband of Lawrence County to be served on Berry Slater and Sarah Slater his wife, late Myers, and it is further ordered that publication be made in Brandon Republican, a weekly newspaper, printed and published in the town of Brandon once a week for four weeks successively, directed to Samuel Myers and the children and heirs of Asa Myers dec'd. late of the State of Texas, so far is known; to wit: Alexander Myers - Nancy White and Jesse White her husband, Perry Myers, Carlotta Collins, late Myers, wife of James Collins, Minerva Berry, late Myers, Narcissus Myers, Sylvester Myers, Irvin Myers, Albert Myers and the other heirs of Asa Myers whose names unknown to petitioner and to be designated by the description of the unknown heirs of Asa Myers - all citizens of the State of Texas - and also to William Myers and Gracey Dunagan, late Myers of the State of Texas - children and heirs at law of John Myers dec'd.
And it is further ordered that Mala Fox, be and is hereby appointed guardian ad litum to Alexander Myers, Perry Myers, Narcissus Myers, Slyvester Myers, Irvin Myers, Albert Myers and the unknown heirs of Asa Myers dec'd. and also the following minors; heirs of Chapman Myers dec'd. to wit: Aphalonia, Leonidas, Nancy, Alonzo, Pizano, Thomas and Catherine Myers, and also for William L. Ragland, Austin Ragland, Orasamus J. Ragland and Mary Jane Ragland, Louella Ragland, minor heirs of Mary Jane Ragland, it appearing to the satisfaction of the court that all the above named minors having no guardian or guardians and it is further ordered that said Fox, guardian ad litum" be cited accordingly, all of said citations and publications and publications requiring all and each of said parties to be and personally appear at this court at the next term thereof, and on the 4th day of said them, then and there to answer the petition of said William Ragland Adminidtrator aforesaid for the sale of all the personal property and slaves of said Gracy Myers dec'd. and to show cause if any they can, why the prayers of said petition should not be granted.
