He enlisted in 1778 and served as a substitute for his brother, William Nay for eighteen months, again enlisted on March 1, 1781 as a substitute for John Nay and served three months in Captian Waugh's Company, Colonel Barbour's Virginia Reg., and enlisted a third time serving for three months as a private in Captain Kad Slaughter's Co., Col. John Slaughter's Virginia Reg. His request for a pension was denied based upon his failure to provide evidence that he served for six months.
