Brings Suit To Have Case Re-opened
__MARY ZARUBA NOT SATISFIED WITH THE SETTLEMENT.
__FOR THE DEATH OF HER HUSBAND WHO WAS KILLED.
__Case Was Settled by the Payment of $750, but Mrs. Zaruba Alleges That It Was Not Done With Her Consent.
__Alleging that a settlement of a suit for damages was settled without her knowledge or consent, Mrs. Mary Zaruba of this city has commenced an action in the district court against Douglas and Co. and James E. Lawler, asking that the settlement be set aside and the case be re-instated on the docket.
__Mrs. Zaruba sets out in her petition that her husband was killed Oct. 20, 1905, and that some time thereafter, she brought a suit for damages against Douglas and Company. James Lawler was appointed as the administrator of the estate she says, and a personal injury suit was started against Douglas and Co. Mrs. Zaruba alleges that she distinctly expressed her wishes that no settlement be made for less than $2,000. Notwithstanding this, it is alleged that the defendants settled the case for $750, and that she was not consulted in any way or manner in this settlement. She asked that the case be re-instated on the docket.
NOTE: Probate record # 3956, indicates that A. W. Kool had been asked to be administrator of this estate. He declined - so James E. Lawler was asked. Mr. Lawler accepted. Mr. Lawler hired 2 lawyers who claimed half ($375) of the $750 settlement as their fee. The balance: Clerk of court, $8.50; administrator - James E. Lawler, $37.50; widow - Mary Zaruba, $109.66; daughter - Mary (Zaruba) Horn, $54.84; 3 other minor children, $164.50.
