Charles was the third of seven children, and the oldest son, born to Alice Edna Ackley and Charles Embley Rustay Sr. He married Althea Hickok and they raised three sons. He attended evening school in aviation at Burgard Vocational High School in Buffalo, New York, and graduated in 1935.
