Will Book Pp 104-106

In the name of God Amen

Be it Remembered that I William Stone of the county of Jackson and state of Tennessee do make and declare this my last will and Testament setting aside and disannulling all former Wills or Testaments by me made heretofore and confirming this as my last Feeling myself in a weakly or infirm state of body though of sound mind and memory and calling to mind that I must shortly have this time world. I resign my Soul to God who gave it to be committed to its mother Earth and as to the world substance which God in his providence has blessed me with to dispose of in the following manner (to viz).

All and every part of my worldly substance I will and bequeath to my beloved wife Ann during her natural life to dispose of she thinks worth fit and expedient and her decease I allow the Land that my son Uriah Stone now lives on containing one hundred and Eleven Acres to be his property and the place I now live on to be the property of his son Asbury according to the deed of conveyance I have previously made each of them Asbury's containing fifty six Acres in full of their portion or part of my substance the Remainder of my substance except my black man Thomas that may just be disposed of by my wife if she survives or not or out lives me I allow and bequeath to my daughter Jane Roberts, Ann Smith and my son Elijah Stone and to my Jane Roberts, Ann Smith and my son Elijah Stone and to my granddaughter Lucy Ball in place of her Mother and my daughter who is now deceased to be Equally divided between the four within named and on their reception of the same I allow each of them to weigh in full of their parts of their portion He and my son Elijah has no heirs I allow his receipt to certify that any part of his portion that he may not have occasion to make use of for his own convenience to disced to my Grandson Asbury Stone at his decease also I desire that my executors should take an assumpait or voucher in the receipt Given by Edmond and his wife Jane Roberts for their equal parts of my substance that they will faithfully rescind or equally divide their part of my substance between my Daughter Jane's Three children at their decease Viz Westley Spearman, Ann Spearman and Thomas Wm Spearman to the satisfaction of my executors as my Daughter Jane has no children by said Edmond Roberts.

I give and will my black man Thomas his freedom after my own and my wifes' decease but as I am informed that the Law of the Land require that he should give bond with security to the satisfaction the court that he will not be chargeable to the state I therefore demise in case he cannot comply with such legal registration as may be necessary that he may choose for himself whom he will serve and I do will him to that person by them being found to discharge a duty to him according to the laws of humanity.

I do further revoke and constitute Archibald Stone Exec and Jane (James) Crawford both of Barren County Kentucky my executors to this my Last will & Testament. In Witness whereof I have hereunto set my hand and seal this 24th day of June AD 1819.
