Son of Joshua and Frances Gaines Botts.

He was educated in the law office of General John Minor, and became a prominent lawyer of wide reputation in Prince William County. His reputation was also well established in Fredericksburg and in Richmond, where he became conspicuous on the team of lawyers providing defense for Aaron Burr in his famous treason trial.

Benjamin Botts married in 1798 Jane Tyler of Dumfries, Virginia, with whom he perished at the burning of the Richmond Theater.
