Dr. Leon Davis Jacobs Sr. was born on 01 Dec 1938 in Hickox, Brantley County, Georgia to Leon Audrey Jacobs and Amy Jane (Griffin) Jacobs. He died on 24 Aug 2007 in Waycross, Ware County, Georgia at the age of 68. He was an ophthalmologist and a member of the American Academy of Ophthalmology. He was a graduate of Hoboken High School, South Georgia College, the University of Georgia, Medical College of Georgia, and the Medical University of South Carolina in Charleston, South Carolina.

He was preceded in death by his parents. He is survived by three sons, six grandchildren, one sister, three brothers, an uncle, and numerous nieces and nephews.

Waycross police have charged Betty Jo Jacobs with murder and two other felonies in the shooting death Friday of her former husband, eye doctor L. Davis Jacobs, officials said.


Police secured warrants Friday night charging the 66-year-old woman with murder, aggravated assault and possession of a firearm in the commission of a crime, Ware County Magistrate William Linton said.


Linton said he held a first appearance hearing for Betty Jacobs at 7:30 a.m. Saturday at the Ware County jail where he bound the case over to Superior Court and set no bond.


John Thigpen, a Blackshear attorney representing Betty Jacobs, asked for a preliminary hearing, when the judge determines if there is enough "probable cause" in the case. Because the Magistrate Court calendar is full, it is unlikely a hearing could be held within the next two weeks, Linton said.


Davis Jacobs, a popular ophthalmologist, was seeing patients about 10 a.m. when he was shot to death in the hallway of his office at 403 Lister St. near Satilla Regional Medical Center.


Police arrived within minutes, found Betty Jacobs at the office and took her into custody. The warrant says Davis Jacobs was shot to death with a .38 caliber Smith & Wesson handgun.


The Jacobs' stormy marriage ended in divorce in May. Betty Jacobs had filed for divorce in March 2005 on the grounds of cruelty and that the marriage was irretrievably broken.


While the divorce was working through the court, Davis Jacobs told friends and members of his extended family he and his wife were still living in the same house.


In the final order, Betty Jacobs was awarded the couple's Waycross home while Davis Jacobs was awarded a Brantley County farm and the mobile home on the property.

Jacobs Murder Trial Sept. 8 (2008)

The murder trial of a Waycross woman who shot and killed her husband at his eye clinic nine months ago, according to police investigators, is to take place in September.

Accused murderer Betty Jacobs is to stand trial Sept. 8 at the Ware County Courthouse, although her attorney is seeking to have the trial moved to another city.

Judge Dwayne Gillis set the trial date during a court session Wednesday in the main courtroom of the Ware Courthouse.

Jacobs is charged with shooting to death her husband, Dr. Davis Jacobs, at his Lister Street clinic office here on Friday, Aug. 24.

Defense attorney John Thigpen said a "change of venue" motion will be discussed in July. Thigpen is asking for a change because he believes Jacobs cannot get a fair trial in Ware County because of bias in the jury pool.

The case has been one of high interest since the murder occurred.

Thigpen and and co-defense counsel Andy Spivey do not dispute that their client fired the fatal shot. But, they maintain, she was justified. The defense plans to use the "battered spouse syndrome" as her defense.

However, family members have testified during pre-trial court proceedings Dr. Jacobs, the victim, was the one who was battered (by the defendant).

A three-count indictment returned by a Ware County grand jury charges the defendant with malice murder, felony murder and possession of a firearm (.38-caliber Smith & Wesson pistol) during the commission of a crime.

The indictment states that Betty Jacobs entered the office of Dr. Jacobs on the morning of Aug. 24, 2007 and fired a gun, killing her husband.

She pleaded "not guilty" to the charges.

The late Judge Stephen L. Jackson ordered Jacobs held without bond after her bond hearing at the end of August.
