Herman Henry Winchell was born in Rutland, Vermont, to Henry and Phebe (Smith) Winchell. The family moved to Racine, Wisconsin in 1844. Herman and his wife, Amorette E. Wood, were married in 1848. According to Herman's obituary in the San Jose Daily Mercury (Mar. 1, 1899), he traveled across the plains to California in 1853, then went back East in 1854 for cattle and returned to San Jose in the same year. His wife followed him in 1858. Herman was engaged in the nursery business in San Jose for many years.

Herman H. Winchell died on Feb. 27, 1899, at the age of 78 and was buried at Oak Hill Cemetery per the San Jose Evening News (Mar. 1, 1899). He was survived by his daughter Nellie Winchell. His wife and two other daughters pre-deceased him.

Herman and Amorette had three daughters:

1. Eva E. Winchell, b. about 1853 in Wisconsin, d. Nov. 12, 1871, in San Jose, per Oak Hill Cemetery death certificate.

2. Nellie Winchell, b. June 8, 1859 in San Jose, d. Dec. 26, 1935 in San Francisco, buried at Cypress Lawn Cemetery, Colma, Cal.

3. Maude Winchell, b. abt. 1864 in San Jose, d. July 12, 1895 in San Jose (San Jose Daily Merc.)
