STATE OF NEW YORK --GENESEE COUNTY SURROGATE'S COURT

To the Surrogate of the County of Genesee:

The Petition of MARGARET BRAYTON of the Town of Batavia in the County of Genesee, respectfully represents that She is the widow of Albert S. Brayton, late of the Town of Batavia in the County of Genesee, deceased. That the said ALBERT S. BRAYTON departed this life on the 5th day of October, 1868 at Batavia, aforesaid.

That He died intestate, as your Petitioner verily believes for the following reasons, viz: The deceased had a Will drawn just before he died but did yet [record?] it.

That He died possessed of certain Personal Property.......... the value whereof does not exceed the sum of Fifteen Hundred dollars, according to the best knowledge, information and belief of your petitioner; And that the whole property and estate, both real and personal of which the said deceased died seized or possessed, does not according to the best knowledge, information, judgment and belief of your petitioner exceed the value of Thirty-Eight Hundred dollars.

That the said intestate left kindred entitled to his estate, whose names and places of residence, so far as your petitioner upon diligent inquiry has been able to ascertain the same, are as follows, viz:
