KILLED BY AN OUTLAW

W.B. McDaniel of This County Killed in the Indian Territory

The remains of W.B. McDaniel, who was killed last Friday in the Indian Territory by Bob Rogers, the outlaw, were brought to Marshall, Ind and to the home of the dead man's brother, C.E. McDaniel, Monday afternoon. The funeral was held yesterday in the Baptist church at Marshall, services by Rev. S.K Fuson, and the burial was at Bethany cemetery.
From the Coffeyville, Kan., Daily Journal of Saturday, March 16, the details of the tragedy are obtained.
For the past two years a murderous gang of outlaws, under the leadership of Bob Rogers, has infested the northern part of the Cherokee nation. The band had recently begun depredations anew and McDaniel and others had suffered the loss of stock. The outlaws established headquarters at the home of Rogers' father, on Big Creek, 20 miles southwest of Coffeyville. McDaniel's ranch is situated about three miles northwest of the Rogers farm. Last Friday, it was learned that Bob Rogers and a companion were at home. Deputy U.S. Marshall Mayes decided on their capture and called to his assistance a posse of 11 citizens, McDaniel among the number. That evening they surrounded the house. The marshal, McDaniel and one or two others entered the building, arousing a hired hand who informed them that his companion had gone away early in the evening. In the meantime, the father had come on the scene, and as Bob refused to come down when ordered by the marshal, the old man was commanded to proceed, light in hand, up the stairway, the officer and his men following. No sooner had the upper room been reached than the light was extinguished and two reports from the outlaw's Winchester came in quick succession. At the first shot McDaniel fell with a bullet through his heart and the second shattered a man's arm. The posse beat a hasty retreat from the house, being forced to leave McDaniel's body behind, and held a hurried council. It was decided to not give up the attempt at capture and the desperado was ordered to come downstairs with his hands up and he would not be hurt, otherwise the house would be burn down. He refused to do this, but at length again a proposition given to come with his Winchester muzzle down, and he soon appeared below. But the ready gun was in position for action instead of that agreed to, and catching sight of the marshal and now a thoroughly desperate man drew a bead on him. This proved a fatal move for him, for in an instant he was covered with half a dozen rifles, as many reports resounded in the gloom and the outlaw fell riddled with bullets. The body was turned over to the father, and that of McDaniel secured and taken to his late home.
W.B. McDaniels, was born in Parke county, Dec. 8, 1847, and from 1860 to 1833 lived with his brother, C.E. McDaniel, now of Marshall, this county. He served nine months under Gen. Custer in the Apache war. In the fall of 1883 he went to the Indian territory where he had a large ranch and did an extensive stock business, being in very precarious circumstances at the time of his death. He was unmarried.
This is the second of Parke County's citizens to meet an untimely death at the hands of Indian territory outlaws, the first being Charles Connelly who while in the faithful performance of his duty as marshal of Coffeyville, Kan., was shot through while attempting the capture of the Dalton gang. McDaniel was in Coffeyville at the time of this occurence.
