Confederate Smith was convicted of being a guerrilla & was hanged by the Union Army in St. Louis. A former preacher, Smith enlisted as a private in Major Lee Randall's battalion. Union authorities argued that Smith "lurked & traveled about" within their lines armed as "an outlaw & guerrilla." They also decided that his "unit" was not a lawful military organization but one whose purpose was to engage in "petty warfare" through "raid, extortion, destruction & oppression."
