August Court 1804 Halifax County, Virginia

To the wonderful court of Halifax County, sitting in chancery humbly complaining herewith to your worships your orator JOHN CLAY that on or about the (blank) day of (blank) in the year 1781 your orator purchased of a certain JOSHUA ECHOLS a tract of land lying and being in the county of Halifax aforesaid on the draught of Childress Creek containing four hundred acres and bounded by the land of JOSEPH COLLINS, PETER TRIBLE, MOSES WALDON, and ELIJAH HUNT as will manifestly appear by a reference to the the said ECHOLS(blank) said to your orator for a right to the same which is hereunto and prayed to be considered as part of your orator bill of complaint, that the said ECHOLS purchased the land aforesaid of a certain THOMAS POWERS who give the said ECHOLS his obligation to make him a fee simple estate to the same that POWERS purchased the said land of WILLIAM MARTIN, now dec'd the original patantee who also give POWERS his obligation to make him a fee simple estate to the same with a general warrranty which said obligations are hereunto and prayed also to be taken as par of this bill of complaint.....that the said WILLIAM MARTIN departed this life on or about the (blank)day of (Augest--handwritten) in the year 17(83--handwritten) intestate and without making a conveyance to the land aforesaid so that the legal estate became vested in BENJAMIN MARTIN, his only son and heir.....under the then....law of ....that the said BENJAMIN MARTIN departed this life also intestate and without having made a conveyance under the present law so that the legal estate became vested in PHILADELPHIA MARTIN, now the wife of MOSES MARTIN, TABETHA MARTIN, now the wife of JAMES GARNER, SAMANTHA MARTIN, PRISCELLA MARTIN, RODA MARTIN and POLLY MARTIN, sisters and legal representatives of the said BENJAMIN MARTIN, dec'd. Your orator further states that the aforesaid JOSHUA ECHOLS moved to the state of Georgia and has departed this life as your orator is informed and left the following children, vez, JOHN ECHOLS and FLEMING ECHOLS, that the said POWERS another defendant has also removed to the state of North Carolina where he now resides.
That your orator has long since paid to the ECHOLS the whole of the purchase money and will hopes to prove to the satisfaction of the court that the said POWERS and MARTIN were paid satisfying for the same; that your orator has been in the possession of land and premises aforesaid were since his purchase from ECHOLS. Your orator further states that he has made proper application to the aforesaid parties for a legal conveyance to the land aforesaid as in good conscience they ought to make but so it is may it please your worships that the aforesaid parties have refused to comply with your orators reasonable (blank) who is remediless in the premises at common law only by the (blank) of this worshipful court. To the end that the said MOSES MARTIN and PHILADELPHIA, his wife, JAMES GARNER and TOBE, his wife, (blank) MARTIN, PRISCELLA MARTIN, RODA MARTIN and POLLY MARTIN, heirs of WILLIAM MARTIN and legal representatives of BENJAMIN MARTIN and JOHN ECHOLS and FLEMING ECHOLS heirs of JOSHUA ECHOLS dec'd and THOMAS POWERS may be made defendants to this his bill of complaint and that they may upon this corporal oath here and perfect answer make to the matter herein states and charges and particularly to say whether they have not been long since paid satisfied the fully for land aforesaid and so their cause if any they can why this worshipfull court may not order and decree that the aforesaid MOSES MARTIN and PHILADELPHIA his wife and JAMES GARNER and TABITHA his wife and the said JOHN ECHOLS and FLEMING ECHOLS and THOMAS POWERS by proper deed conveyed the fee simple estate with general warrantee to the land aforesaid to your orator agreeable to the several covenants hereto annexed, and that your orator by a decree of this worshipfull court may be granted in the possession of land and premises aforesaid against the defendants and all and every person whosoever claiming or to claim under this or either of them and that he may have such other and further relief in his premises as his case may require...and may please your worships to grant the commonwealth writ of suppe darcetis to the said defendents command them to answer and your orator as in duty will pray.

Halifax Co., VA Chancery case 1804-028, John Clay vs. Moses Martin & wife.
This chancery case was brought in order to resolve ownership of land which had previously belonged to William Martin who was now deceased. Benjamin Martin was listed as the only son of William Martin, who is also now deceased. Other descendants of William Martin are listed as Philadelphia Martin, wife of Moses Martin, Tabitha Martin, wife of James Garner, Susannah Martin, Priscilla Martin, Roda Martin, and Polly Martin, all of whom were possibly living in Montgomery County, Virginia in 1803 when they were summoned to court to answer this Bill in Chancery. (Priscilla Martin signed her name as Priscilla Green on her reply to the summons. Samuel Green also signed the document and it is assumed he was her husband.)

When William Martin sold 100 acres of land in 1772 it was described as part of 400 acres belonging to Henry Martin, deceased, father of William Martin, and being the place where William Martin lately lived, bounded by Humphrey Kibble, Thomas Moore, Henry Martin, and Benjamin Martin. William Martin was living in Halifax Co., VA and had married Rachel prior to 28 Dec. 1772. (Cumberland Co., Deed Book 5, pg. 124)
