He served in that rank until June 15, 1862, when he was promoted to Captain and commander of the company, replacing Captain Martin C. Frost, who was killed in action at the June 8, 1862 Battle of Fair Oaks.
He led the company for a month, and was sent home to Philadelphia on July 11, 1862 due to illness. He never returned to the regiment, and was honorably discharged due to disability on January 26, 1863.
On October 30, 1890 he filed for a US Army Invalid Veteran Pension (Application #893019, Certificate #773963).
On October 3, 1898 his wife, Mary L. Fimple, filed for a US Army Widow's Pension (Application #683554, Certificate #475172).
