He was convicted of killing Frank Pitts, a bank teller, and sentenced to die in the electric chair at the McAlester State Penitentiary Feb. 1, 1924. One of his accomplices, Allison Ives, was given life without parole. In his last statements Birkes told the warden "I'm not guilty, but I'm not afraid to die". His final bid was a wave of his hands saying "Goodbye boys".
