A Claude man and his two small sons have died of burns received when their pickup was struck by another vehicle and exploded on impact at 7:30 p.m. Sunday, December 18.
The accident occurred 7.1 miles west of Quail on Highway 203, according to DPS patrolman Herbert Duncan.
He identified the victims as Roger Len Hart, 30 and his sons, Ty Len Hart, 6, and Clay Powell Hart, 4.
Mrs. Hart was badly burned but her condition late Tuesday was reported as improved. She is in the Burns Center in Oklahoma City.
Driver of the second vehicle was Goldie Calloway, 46, a Clarendon man, who is in Collingsworth General Hospital for treatment of cuts on his face and hands and a deep cut on his left leg. He was accompanied by his 11-year-old son, Kenneth, who was checked at the hospital and released.
Negligent homicide charges were filed against Calloway Tuesday afternoon by County Attorney R.L. Templeton. According to the county attorney, highway patrolmen stationed at Clarendon stopped Calloway in Donley County and issued a speeding ticket, which notes he was driving 76 miles per hour. He was not detained.
Patrolman Duncan, who headed the investigation, said the Hart family was returning to Claude after apparently visiting his parents, Mr. and Mrs. Curtis Hart at Vinson, OK. The Calloway car, a 1970 Buick was traveling east.
The vehicles hit head on, left front to left front, in the west bound traffic lane, Duncan said.
After impact, the Buick plowed down the left side of the pickup, then hit the two wheel trailer it was towing.
The Hart vehicle exploded, overturned two or three times and came to rest on its side in the bar ditch on the north side of the highway. The Calloway car spun around and stopped on the pavement headed west, according to the patrolman.
Traffic was blocked at both ends of the accident scene from 7:30 until 10:00 and rerouted on a county road.
The burning pickup set fire to grass along the highway right of way and in the adjoining Allen Ranch, and was put out by the Wellington Fire Department.
After emergency treatment at Collingsworth General, Mr. and Mrs. Hart were transferred immediately to High Plains Hospital in Amarillo, where Mr. Hart died Monday night. Mrs. Hart was transferred by plane to the Burns Center in Oklahoma City, Monday.
Ty Lynn Hart died in Collingsworth General at 8:15 p.m. and Clay Powell at 8:53.
Roger Lynn Hart was born July 8, 1947, at Erick, the son of Mr. and Mrs. Curtis E. Hart, now of Vinson. He lived at Erick, Vinson, Mangum, Amarillo and Claude. He was married to Miss Carolyn Lucille Snodgrass of Springfield, Colorado in 1968.
Mr. Hart was employed by the Santa Fe Railroad Company.
Survivors are his wife; his parents, and three sisters, Mrs. Brenda Ellis and Leah Beth Hart of Vinson and Sharon Hart of Dallas.
Surviving the two boys besides their mother and paternal grandparents are their maternal grandparents, Mr. and Mrs. Ralph Snodgrass of Springfield.
