General: James H. Spear and Elizabeth Cox married 10 January 1860, probably in Smith County, Texas, as they are enumerated in the 1860 Census in that county. Their daughter, Mary Lucinda was born 10 Mar 1861. He enlisted as a private in Company D of the Texas 10th Cavalry Regiment of the Confederate States Army in Quitman, Texas on 25 September 1861. The 10th Cavalry served in Arkansas, Louisiana and Texas during the first few months of the war. In 1862 it was ordered east of the Mississippi, was consolidated with the 14th Cavalry Regiment and dismounted. The 10th Texas Cavalry fought in Ector's Brigade, Army of Tennessee and engaged in the Corinth Campaign (April-June 1862), Kentucky Campaign (August-October 1862), the Battle of Richmond (August 30, 1862), and the Battle of Murfreesboro, also known as the Battle of Stone's River (December 31, 1862-January 3, 1863). Spears was wounded seriously in the left arm and from that time forward reported absent on the Company Muster Rolls, missing since the battle of Murfreesboro. He appears on a list of killed, wounded and missing, in Maj. Gen. McCown's Division, Army of Tennessee, at the Battle in front of Murfreesboro, Tenn., Dec 31, 1862.
