Marshall Scott Powell of Greenfield Acquitted of the Charges Against Him
The trial of City Marshall Scott Powell on charges preferred against him in writing by Scott Kerr, W. H. Sellers and D. A. Lefever, three electors of the village, was concluded at the Council Chamber on Wednesday afternoon and Powell was acquitted by a vote of 4 to 2.
It was charged that the Marshall had unlawfully and without authority collected $2 as a license from John Smith, otherwise known as "Cheap John," for selling goods on the street and had converted said funds to his own use; also, that he had on July 4th last arrested Frank Gongworthy for drunkenness and had released him on the payment of $4.50 and had converted the money to his own use and had made no proper report to the Mayor.
Powell was represented by Dickey and Irwin. W. H. Eckman, who is a member of the Council, prosecuted the case and was assisted by Mills Gardner. Strong objection was made by the counsel for the defense against the right of Eckman to sit as a member of the council and also against the right of Mayor Milholland to testify as a witness.
The material facts set forth in the second charge were not denied by the defense but testimony was introduced to show that Gongworthy had been arrested by the Marshall some time before and had been fined but the fine had not been paid. When arrested in July last no formal charge was preferred against him and the Marshall released him with his promise that he would pay the fine already standing against him. The fine was afterwards paid by Beardsley Limes for Gongworthy. It seems that it has been costomary for the Marshall to collect old fines during the Mayor's absence and hand them over to him. Powell claims that the money would have been paid over at his settlement with the Mayor on August 1.
The testimony in substantiation of the first charge was also deficient as it was not proved that "Cheap John" had paid Powell but one dollar, which was the amount turned over by Powell to the Mayor.
The vote of the Council on the first ballot stood four for acquittal and two for conviction. As a vote of two-thirds is necessary for conviction the charges were not sustained. The members of the Council are J. F. Waddell, A. B. Southward, W. H. Eckman, James Smith, James Murray, Jr., and James Massie. It is not known whether Massie or Murray voted with Eckman for conviction.

Scott Powell Comes Back at W. H. Eckman, Charging Misappropriation of Funds
"The Chillicothe Leader" in its last issue gives a column and a half of particulars concerning crooked municipal affairs in Greenfield, on which the "Greenfield Enterprise" is dumb as an oyster. Some time ago, it will be remembered, Scott Powell, Greenfield's Marshall, was hauled up before Council and "investigated" on the charge of appropriating to his own use fines which he had collected. Through the influence of friends nothing came of the charges and Scott was vindicated. Still his feelings were hurt and he laid low for a chance to get even with some of his prosecutors.
Some time ago an Indian Medicine Company rented the City Hall in Greenfield for a period of three weeks at $25 per week. Mayor Milholland collected $50 of this from the manager of the company and was told that the other week's rent had been paid to a certain member of Council. At last week's meeting the fact was discovered that the $25 had not yet been turned in and a committee was appointed to see Mr. W. H. Eckman, who was absent, in regard to the matter. He would not deny having received the money but would give no explanation.
At this stage of the proceedings Powell made an appearance and filed charged against Mr. Eckman, alleging the appropriation of the missing week's rent and demanding that Council take some action in the matter. The mayor immediately called a special meeting of Council and Mr. Eckman was ordered to appear on Monday night and answer the charges. Council met on Monday night pursuant to this call and the investigation was begun. Mr. Eckman acknowledged having received the money and upon his turning over the amount Council decided to carry the matter no further.
