Dispute over correct birth location not resolved. Some claim it is Perry County which is the first known record for Daniel at about 5 to 7 years of age with census is known. Census can only be used for a state level birth and even then they are not always correct for the state of birth. Obituary claims Henderson County as birth place and he did grow up there but common for people to claim they were born in the first place they remember living.

Daniel was first married to Elnora C. Alexander on December 21, 1887 in Carroll County, Tennessee. At least two children both sons known from his first marriage were Mac Alexander Tracy and Shelley Edward Tracy. Elnora appears to have died before 1900 as their children in 1900 were living with their Alexander grandparents.

Railroad Meeting.

The Commercial Club of Elk City held a rousing meeting last Friday evening. The large hall was filled to overflowing. Senator Echols made quite a reminiscent talk of the early days in Elk. And Judge Tracy made a strong argument by comparing the old way and the new way, and of the necessity of further progress. The addresses of both gentlemen were well to the point. And ye scribe took a shot at the practical end of the work.

Taking everything into consideation(sic) it was a good meeting partaking more of the old-time spirit of Elk City, bringing people together again for the common good. Let's follow it up and get closer together.

Judge Tracy is a native of Tennesee(sic) and becoming early imbued with the spirit of the west moved as a young man to Vernon Texas, where he practised law for several years, and when Oklahoma opened, like the rest of the world, sought his mecca then. He opened an office in Cheyenne Oklahoma, and engaged in the practice of law for a number of years, and incidently(sic) in the country newspaper business, but the railroad having built elswhere(sic) he moved to Elk City and engaged in the practice, having a fine library on the corner of Main and Broadway in the Watson building. The Judge having successfully held the office of County Attorney of Roger Mills County for a term seems to be fully satisfied with politics except as a good loyal democrat of the uncompromising school, he devotes his entire attention to the law practice in which he has built up a good one.

Judge D. W. Tracy, who was for several years a practicing attorney in this city has returned to Sayre to become associated with Adali M. Hendrix in the practice of law. Their office is located next door to the Owl Drug Store on North Fourth Street.

Judge Tracy is well known in Sayre and Western Oklahoma. He came to this country when it was first opened for settlement and was for several years engaged with Judge John C. Hendrix, father of his present partner in the practice of law.

The judge, up until returning here was engaged in the practice of his profession at Pampa, Texas. He and Mrs. Tracy and their son, Raymond have moved to their home at 708 north Fifth Street.

Interesting Review Of Washing-
ton And His Greatness
Are Told

Kiwanis club inter-relations meeting will be held at Cheyenne Tuesday night, it was announced at the luncheon of the Sayre club Wednesday noon.

The meeting will be held with the Cheyenne club as host. It will begin at 7 o'clock. With one or two exceptions, the entire membership of the local club will attend the meeting. Sayre will furnish a portion of the program.

A Program commemorating Washington's 200th birthday was given at the luncheon yesterday at the First Christian church.

Miss Ruth Evins gave three appropriate readings heartily enjoyed by the club.

Judge D. W. Tracy made a spirited talk in keeping with the program. He declared that Washington was not an exceptionally brilliant man or was he a genius from any standpoint. Three things, the speaker said are responsible for Washington going down in the annals of history as one of America's greatest and most beloved characters, his patriotism, dependability, and his courage.

The same principals, the same patriotism and the same courage that was Washington's is needed to carry the United States back to normalcy today, the judge declared.

Rev. Archie Taylor of Elk City was a visiting Kiwanian.

Oscar Speed, president, arranged the program. J. Charles Smith, vice-president presided.

D. W. Tracy, Sayre attorney, was appointed County Judge to fill the unexpired term of Judge Lyle Brewer, resigned, by the county commissioners at their regular monthly meeting Monday night, October 2, 1944, Commissioner J. A. Hawkins reported.

Judge Brewer resigned September 15 effective October 1, to accept the position of business manager of the Community hospital at Elk City, since which time only immediate affairs of the office have been acted upon by Brewer there.

Judge Tracy assumed the office Tuesday morning, October 3, 1944.

Last rites for Daniel Webster Tracy, prominent attorney and retired county judge, were held at 3 p. m. Sunday at the Sayre Baptist church. He died Friday night at his home, 801 north Fourth, following a lengthy illness.

Judge Tracy was born January 22, 1862 in Hendercon county, Tennessee and came to Oklahoma in 1902. On January 25, 1902 he was married to Annie Anderson in Cheyenne.

He is a long time member of the Baptist church and served as deacon.

He moved to Sayre from Cheyenne in 1909. He served as county attorney before statehood and served as president of the county bar association in the day of its organization.

Survivors Include his wife, Mrs. Annie Tracy of the home address; three sons, M. A. Tracy Dallas. Texas; J. A. Tracy of Bellflower, California; R. C. Tracy of Sayre: one daughter, Mrs. Ollie Sides, Sayre. One daughter and one son preceded him in death.

The Rev. Kenneth Mullins officiated assisted by Rev. Tommie Carmichael, Amarillo. Tracy Carey, grandnephew, served as organist.

Burial was in the Sayre-Doxey cemetery with the Scroggins Funeral home in charge of arrangements.
